Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the InloveApp website at https://inloveapp.com, the InloveApp mobile applications, and all related features and services (together, the "Service"). InloveApp is a product and brand operated and provided by NGOBSUNLLC ("we", "us" or "our").

Please read these Terms carefully. They form a legally binding agreement between you and us. Our Privacy Policy, GDPR Privacy Rights page and Refund and Cancellation Policy are incorporated into these Terms by reference.

1. Acceptance of these Terms

By creating an account, accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Eligibility and account requirements

The Service is a relationship building and social-discovery platform intended for adults. You may only use the Service if you are at least 18 years old, or the age of majority in your country if that is higher, and are legally able to enter into a binding contract. By using the Service you represent that this is the case.

You must register with accurate, current and complete information and keep it up to date. You may create only one personal account, and you may not create an account for anyone other than yourself. You may not use the Service if you have previously been removed from it or are prohibited from using it under applicable law.

3. Account security

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Do not share your password or let anyone else access your account. Notify us immediately through the Support page if you believe your account has been accessed without your permission. We are not liable for loss arising from unauthorised use of your account that results from your failure to keep your credentials secure.

4. Acceptable use

You agree to use the Service only for lawful purposes, in a respectful manner and in accordance with these Terms. You agree to treat other members with courtesy, to respect their privacy, and to comply with all laws that apply to you, including laws on data protection, harassment, intellectual property and online conduct.

5. Prohibited conduct

You must not, and must not attempt to:

• impersonate any person, misrepresent your identity, age, gender or intentions, or use another person's photographs or details;
• harass, threaten, intimidate, stalk, defame, abuse or discriminate against any person;
• post or send content that is unlawful, obscene, pornographic, sexually explicit, violent, hateful, or that exploits or endangers minors in any way;
• solicit money, gifts, financial information or payments from other members, or use the Service for fraud, scams, commercial solicitation, prostitution, escort services or human trafficking;
• send spam, chain messages, unsolicited advertising or bulk messages, or use bots, scripts, scrapers or other automated means to access or interact with the Service;
• upload viruses or malicious code, probe or attack the security of the Service, or interfere with its operation or with other members' use of it;
• collect or harvest personal data of other members, or publish another person's private information without consent;
• infringe any copyright, trademark, privacy, publicity or other right of any person;
• circumvent or manipulate any payment, credit, referral, bonus or moderation mechanism of the Service; or
• use the Service in a way that breaches applicable law or these Terms.

6. User-generated content

The Service allows you to publish profile information, photos, videos, feed posts, comments, gifts, messages and other material ("User Content"). You retain ownership of your User Content. By submitting User Content you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, display and distribute it solely for the purpose of operating, promoting and improving the Service, in accordance with your privacy settings. This licence ends when you delete the content or your account, except where the content has been shared with others who have not deleted it, or where we are required to retain it by law.

You are solely responsible for your User Content. You confirm that you own or have the necessary rights to it, that it is accurate where it concerns you, and that it does not breach section 5. We do not endorse any User Content and are not responsible for it.

7. Messaging and social features

The Service includes messaging, friend, like, match, guest, feed and gift features. Interactions with other members are at your own risk. We do not carry out criminal background checks on members and we do not verify the identity, statements or intentions of any member, even where a profile displays a "verified" badge, which only indicates that certain checks selected by us were completed. Always use caution when communicating with or meeting other members, never send money to someone you have met through the Service, and report any concerning behaviour through the Support page or the in-app reporting tools.

8. Moderation and enforcement

We may, but are not obliged to, review, moderate, remove or refuse any User Content, including photos and profile information submitted for moderation, at any time and without notice. We may investigate suspected breaches of these Terms and take any action we consider appropriate, including issuing warnings, removing content, restricting features, suspending or terminating accounts, and reporting unlawful activity to law enforcement. Our decisions on moderation and enforcement are made at our reasonable discretion.

9. Subscriptions and paid services

Some features of the Service are free and others are paid. Paid features may include premium or "Pro" plans that unlock additional functionality for a fixed period or on a recurring basis, message packages, visibility features such as Spotlight, an ad-free experience, a verified badge, virtual gifts and similar upgrades. The features, prices and billing periods available to you are shown in the Service before you buy.

By purchasing a paid feature you authorise us, or the payment provider named at checkout, to charge the total price shown, including any applicable taxes, to your chosen payment method. Where a plan is described as recurring, it renews automatically at the end of each billing period at the then-current price until you cancel. Purchases made through the Apple App Store or Google Play are subject to the terms and billing processes of those stores.

Prices may change. Any change to the price of a recurring plan will be communicated to you in advance and will apply only from the next billing period after the notice, so that you have the opportunity to cancel first.

10. Virtual credits and purchases

The Service uses virtual credits ("Credits") as an in-Service currency. Credits can be purchased in packs, may be granted as registration, referral or promotional bonuses, and can be spent on paid features, gifts and upgrades within the Service. Credits are a limited, personal, revocable, non-transferable licence to use certain features of the Service. Credits have no monetary value, are not currency or property, cannot be exchanged for cash or transferred to other members or accounts, and may not be sold or traded outside the Service. Bonus Credits that were granted free of charge have no cash value and are never refundable.

Credits spent on a feature, gift or upgrade are consumed at that moment and the corresponding feature is delivered immediately. Unused purchased Credits remain on your balance while your account remains active and in good standing. We may change the price of Credits, the features that can be purchased with Credits, or the number of Credits required for a feature, but such changes will not reduce the Credits already on your balance.

11. Cancellation

You may cancel a recurring plan at any time through your account settings, the Upgrades or Balance section of the Service, or the app store through which you purchased it. Cancellation takes effect at the end of the current billing period, and you keep access to the paid features until then. You may close your account at any time using the account deactivation option in your settings. Closing your account does not automatically cancel a plan billed through an app store; you must cancel that plan with the store as well.

12. Refunds

Refunds for subscriptions, plans, Credits and other purchases are handled in accordance with our Refund and Cancellation Policy, which forms part of these Terms. Nothing in these Terms limits any statutory right to a refund that you have as a consumer under the laws of your country of residence.

13. Suspension and termination

We may suspend, restrict or terminate your access to the Service, with or without notice, if we reasonably believe that you have breached these Terms, that your conduct may harm other members, us or third parties, that your account is being used fraudulently or in an unauthorised way, or where we are required to do so by law. If we terminate your account for a breach of these Terms, you will not be entitled to a refund of any unused subscription period or Credits, except where the law requires otherwise. We may also discontinue or modify the Service, or any part of it, at any time; where we discontinue a paid feature that you have paid for in advance, we will provide a proportionate refund or an equivalent alternative.

On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination, including sections 6, 10, 12 and 14 to 18, will continue to apply.

14. Intellectual property

The Service, including its software, design, text, graphics, logos, trademarks, and all content other than User Content, is owned by us or our licensors and is protected by copyright, trademark and other intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose in accordance with these Terms. You may not copy, modify, distribute, sell, lease, reverse engineer or create derivative works from any part of the Service, or use our name, logo or trademarks, without our prior written permission.

15. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties or representations, express or implied, about the Service, including any warranty that it will be uninterrupted, error-free, secure or free of viruses, that any defect will be corrected, or that it will meet your requirements. We make no warranty as to the accuracy, conduct or compatibility of any member, or that you will find a match or achieve any particular result. Content provided by other members reflects their views, not ours.

16. Limitation of liability

To the fullest extent permitted by law, we and our directors, employees, agents and suppliers will not be liable to you for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or opportunity, arising out of or in connection with the Service or these Terms, however caused. To the fullest extent permitted by law, our total aggregate liability to you for all claims arising out of or in connection with the Service or these Terms will not exceed the greater of the amount you paid to us for the Service in the twelve months before the event giving rise to the claim and one hundred US dollars (USD 100).

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by applicable law. If you are a consumer, nothing in these Terms affects your statutory rights.

17. Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless from any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of your User Content, your use of the Service, or your breach of these Terms or of any law or third-party right.

18. Governing law and disputes

These Terms are governed by the laws of the country in which NGOBSUNLLC is established, without regard to conflict-of-law rules. If you are a consumer, you also benefit from any mandatory provisions of the law of the country in which you reside, and you may bring proceedings in the courts of that country. We encourage you to contact us through the Support page first so that we can try to resolve any dispute informally.

19. Changes to the Service and to these Terms

We are continually improving the Service and may add, change or remove features at any time. We may also update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Service with a new "Last updated" date and, where appropriate, by notifying you within the Service or by email. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of them. If you do not agree to the updated Terms, you must stop using the Service and may close your account.

20. General

These Terms, together with the documents incorporated into them, constitute the entire agreement between you and us regarding the Service. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign or transfer these Terms; we may assign them to a successor or affiliate that operates the Service.
